| （目的） 第一条 この法律は、平成二十三年三月十一日に発生した東北地方太平洋沖地震に伴う東京電力株式会社福島第一原子力発電所の事故（以下「東京電力原子力事故」という。）により放出された放射性物質が広く拡散していること、当該放射性物質による放射線が人の健康に及ぼす危険について科学的に十分に解明されていないこと等のため、一定の基準以上の放射線量が計測される地域に居住し、又は居住していた者及び政府による避難に係る指示により避難を余儀なくされている者並びにこれらの者に準ずる者（以下「被災者」という。）が、健康上の不安を抱え、生活上の負担を強いられており、その支援の必要性が生じていること及び当該支援に関し特に子どもへの配慮が求められていることに鑑み、子どもに特に配慮して行う被災者の生活支援等に関する施策（以下「被災者生活支援等施策」という。）の基本となる事項を定めることにより、被災者の生活を守り支えるための被災者生活支援等施策を推進し、もって被災者の不安の解消及び安定した生活の実現に寄与することを目的とする。 |
(Purpose) Article 1 Given that, following the accident at the Tokyo Electric Power Company Incorporated Fukushima Daiichi Nuclear Power Plant, which resulted from the 2011 earthquake off the Pacific coast of Tōhoku on the 11th March 2011 (hereinafter referred to as the “TEPCO Nuclear Accident”) radioactive materials have spread widely, and that, because the risk of radiation from the said radioactive materials on human health is not fully understood scientifically, those who reside in or used to reside in areas where radiation levels exceed a certain threshold and those who have been forced to evacuate these areas under the evacuation instructions of the Government as well as those in similar circumstances (hereinafter referred to as the “Victims”), are concerned about their health and are forced to bear the burden in their everyday lives, there is now a need for supporting the Victims and a special consideration has been requested to be given to children who have been affected, the underlying principles for the measures relating to living support and suchlike for the Victims with special attention to children (hereinafter referred to as “Victim Living Support Measures”) are established by this Act with the purpose of promoting Victim Living Support Measures to protect and support the everyday lives of the Victims, with the aim of freeing the Victims from anxiety and contributing to realization of stable life. |
| （基本理念） 第二条 被災者生活支援等施策は、東京電力原子力事故による災害の状況、当該災害からの復興等に関する正確な情報の提供が図られつつ、行われなければならない。 |
(Basic Principles) Article 2 Victim Living Support Measures must be implemented while accurate information is provided in relation to the disaster situation caused by the TEPCO Nuclear Accident and the recovery from the disaster. |
| ２ 被災者生活支援等施策は、被災者一人一人が第八条第一項の支援対象地域における居住、他の地域への移動及び移動前の地域への帰還についての選択を自らの意思によって行うことができるよう、被災者がそのいずれを選択した場合であっても適切に支援するものでなければならない。 | 2. Victim Living Support Measures must ensure that the Victims will be supported properly regardless of whether each Victim decides to reside in the area where support will be provided under Article 8 (1) of this Act, moves to other areas, or returns to the areas they inhabited before the evacuation, so that the Victim can make their own decision freely. |
| ３ 被災者生活支援等施策は、東京電力原子力事故に係る放射線による外部被ばく及び内部被ばくに伴う被災者の健康上の不安が早期に解消されるよう、最大限の努力がなされるものでなければならない。 | 3. In relation to Victim Living Support Measures, maximum endeavors must be made to be able to alleviate the Victims’ health concerns early on, relating to external and internal radiation exposure caused by the TEPCO Nuclear Accident. |
| ４ 被災者生活支援等施策を講ずるに当たっては、被災者に対するいわれなき差別が生ずることのないよう、適切な配慮がなされなければならない。 | 4. In preparing Victim Living Support Measures, due consideration must be given to ensure that the Victims shall not be unreasonably discriminated against. |
| ５ 被災者生活支援等施策を講ずるに当たっては、子ども（胎児を含む。）が放射線による健康への影響を受けやすいことを踏まえ、その健康被害を未然に防止する観点から放射線量の低減及び健康管理に万全を期することを含め、子ども及び妊婦に対して特別の配慮がなされなければならない。 | 5. In preparing Victim Living Support Measures, considering the fact that children (including fetuses) are more susceptible to the effects of radiation on health, special consideration must be given to children and pregnant women which will include, inter alia, reducing the amount of radiation and ensuring that their health is managed at any cost with a view to prevent any damage to their health. |
| ６ 被災者生活支援等施策は、東京電力原子力事故に係る放射線による影響が長期間にわたるおそれがあることに鑑み、被災者の支援の必要性が継続する間確実に実施されなければならない。 | 6. Given the likelihood that the effect of the radiation due to the TEPCO Nuclear Accident will persist for a long time, Victim Living Support Measures must be carried out without fail as long as there is a need to support the Victims. |
| （国の責務） 第三条 国は、原子力災害から国民の生命、身体及び財産を保護すべき責任並びにこれまで原子力政策を推進してきたことに伴う社会的な責任を負っていることに鑑み、前条の基本理念にのっとり、被災者生活支援等施策を総合的に策定し、及び実施する責務を有する。 |
(Responsibilities of the State) Article 3 Given that the State is socially responsible for protecting people’s lives, bodies and properties from nuclear disasters and is responsible for having promoted a nuclear energy policy thus far, in accordance with the basic principles of the preceding Article, the State has the responsibility to develop comprehensive Victim Living Support Measures and to implement the measures. |
| （法制上の措置等） 第四条 政府は、被災者生活支援等施策を実施するため必要な法制上又は財政上の措置その他の措置を講じなければならない。 |
(Legislative Measures) Article 4 The Government must take any measures including legislative measures or financial measures required to implement Victim Living Support Measures. |
| （基本方針） 第五条 政府は、第二条の基本理念にのっとり、被災者生活支援等施策の推進に関する基本的な方針（以下「基本方針」という。）を定めなければならない。 |
(Basic Policies) Article 5 In accordance with the basic principles set out in Article 2, the Government shall formulate basic policies concerning Victim Living Support Measures (hereinafter referred to as “Basic Policies”). |
| ２ 基本方針には、次に掲げる事項を定めるものとする。一被災者生活支援等施策の推進に関する基本的方向二第八条第一項の支援対象地域に関する事項三被災者生活支援等施策に関する基本的な事項（被災者生活支援等施策の推進に関し必要な計画に関する事項を含む。）四前三号に掲げるもののほか、被災者生活支援等施策の推進に関する重要事項 | 2. Basic Policies shall prescribe the following matters:(1)basic policy concerning the promotion of Victim Living Support Measures(2) matters relating to the Support Target Areas set out in Article 8(1)(3) basic matters relating to Victim Living Support Measures (including matters relating to the plans necessary for the promotion of Victim Living Support Measures)(4) in addition to those listed in the preceding item (3), important matters concerning the promotion of Victim Living Support Measures |
| ３ 政府は、基本方針を策定しようとするときは、あらかじめ、その内容に東京電力原子力事故の影響を受けた地域の住民、当該地域から避難している者等の意見を反映させるために必要な措置を講ずるものとする。 | 3. In formulating Basic Policies, the Government shall take measures necessary to reflect in their contents the opinions of the residents of the areas affected by the TEPCO Nuclear Accident,those who have been evacuated from the affected areas and suchlike. |
| ４ 政府は、基本方針を策定したときは、遅滞なく、これを国会に報告するとともに、公表しなければならない。 | 4. After formulating Basic Policies, the Government must submit them to the Diet and publish them without any delay. |
| ５ 前二項の規定は、基本方針の変更について準用する。 | 5. The preceding two clauses shall apply mutatis mutandis to a change in the Basic Policies. |
| （汚染の状況についての調査等） 第六条 国は、被災者の生活支援等の効果的な実施に資するため、東京電力原子力事故に係る放射性物質による汚染の状況の調査について、東京電力原子力事故により放出された可能性のある放射性物質の性質等を踏まえつつ、当該放射性物質の種類ごとにきめ細かく、かつ、継続的に実施するものとする。 |
(Survey of the status of contamination) Article 6 In order to ensure the effective implementation of living support for the Victims, the State shall conduct a detailed and continuous survey of the status of contamination by the radioactive materials related to the TEPCO Nuclear Accident, for each type of radioactive material, by taking into account the characters and suchlike of the radioactive materials which might have been released by the TEPCO Nuclear Accident. |
| ２ 国は、被災者の第二条第二項の選択に資するよう、前項の調査の結果及び環境中における放射性物質の動態等に関する研究の成果を踏まえ、放射性物質による汚染の将来の状況の予測を行うものとする。 | 2. So as to assist the Victims’ decisions as stated in Article 2 (2), the State shall predict the future status of contamination by the radioactive materials, based on the results of the survey set out in the preceding clause and the results of research concerning the dynamics of the radioactive materials in the environment. |
| ３ 国は、第一項の調査の結果及び前項の予測の結果を随時公表するものとする。 | 3. The State shall publish the results of the survey set out in Article 6 (1) and the results of the predictions set out in the preceding clause upon occasions. |
| （除染の継続的かつ迅速な実施） 第七条 国は、前条第一項の調査の結果を踏まえ、放射性物質により汚染された土壌等の除染等の措置を継続的かつ迅速に実施するため必要な措置を講ずるものとする。 |
(Continuous and rapid implementation of decontamination) Article 7 Based on the results of the survey set out in Article 6 (1), the State shall take necessary measures to rapidly and continuously decontaminate soil and suchlike contaminated by the radioactive materials. |
| ２ 前項の場合において、国は、子どもの住居、学校、保育所その他の子どもが通常所在する場所（通学路その他の子どもが通常移動する経路を含む。）及び妊婦の住居その他の妊婦が通常所在する場所における土壌等の除染等の措置を特に迅速に実施するため、必要な配慮をするものとする。 | 2. In implementing the preceding clause, the State shall give due consideration to implementing decontamination of the soil and suchlike particularly rapidly in areas where children’s residences, schools, and nurseries are situated and in other places where children are usually present (including routes usually taken by children such as school routes), and also in areas where pregnant women reside or are usually present. |
| （支援対象地域で生活する被災者への支援） 第八条 国は、支援対象地域（その地域における放射線量が政府による避難に係る指示が行われるべき基準を下回っているが一定の基準以上である地域をいう。以下同じ。）で生活する被災者を支援するため、医療の確保に関する施策、子どもの就学等の援助に関する施策、家庭、学校等における食の安全及び安心の確保に関する施策、放射線量の低減及び生活上の負担の軽減のための地域における取組の支援に関する施策、自然体験活動等を通じた心身の健康の保持に関する施策、家族と離れて暮らすこととなった子どもに対する支援に関する施策その他の必要な施策を講ずるものとする。 |
(Assistance to the Victims residing in the Support Target Areas) Article 8 In order to support Victims residing in the Support Target Areas (areas where the level of radiation is below that which will require the Government to order evacuation, but above a certain threshold – same meaning hereinafter), the State shall take certain measures to secure medical care, to support children’s schooling, to ensure safety of, and confidence in, food served in household, school, and suchlike to assist local activities to decrease the radiation dose and reduce the burden on the everyday lives of the Victims, to maintain physical and mental health through outdoor activities and suchlike, as well as to provide support for children who have ended up living apart from their families, and any other necessary measures. |
| ２ 前項に規定する子どもの就学等の援助に関する施策には、学校における学習を中断した子どもに対する補習の実施及び学校における屋外での運動が困難となった子どもに対する屋外での運動の機会の提供が含まれるものとする。 | 2. The measures set out in the preceding clause relating to the support of children’s schooling shall include the implementation of additional tutoring for children who had a break in learning at school and the presentation of opportunities for outdoor exercises for the children for whom school outdoor exercises have become difficult. |
| ３ 第一項に規定する家庭、学校等における食の安全及び安心の確保に関する施策には、学校給食の共同調理場等における放射性物質の検査のための機器の設置に関する支援が含まれるものとする。 | 3. The measures set out in the Article 8 (1) relating to securing the safety of and confidence in food served in household, school and suchlike, shall include support in setting up equipments to detect radioactive materials at common kitchen facilities and suchlike for school meals. |
| ４ 第一項に規定する放射線量の低減及び生活上の負担の軽減のための地域における取組には、子どもの保護者等による放射性物質により汚染された土壌等の除染等の措置、学校給食等についての放射性物質の検査その他の取組が含まれるものとし、当該取組の支援に関する施策には、最新の科学的知見に基づき専門的な助言、情報の提供等を行うことができる者の派遣が含まれるものとする。 | 4. The measures set out in the Article 8 (1) concerning the local activities to lower radiation levels and reduce the burden on the everyday lives of the Victims shall include the steps such as decontamination, by children’s guardians, of the soil contaminated by the radioactive materials, and radiation tests of school meals, and the measures supporting these steps shall also include dispatching individuals who can provide professional advice and information based on the latest scientific knowledge. |
| （支援対象地域以外の地域で生活する被災者への支援） 第九条 国は、支援対象地域から移動して支援対象地域以外の地域で生活する被災者を支援するため、支援対象地域からの移動の支援に関する施策、移動先における住宅の確保に関する施策、子どもの移動先における学習等の支援に関する施策、移動先における就業の支援に関する施策、移動先の地方公共団体による役務の提供を円滑に受けることができるようにするための施策、支援対象地域の地方公共団体との関係の維持に関する施策、家族と離れて暮らすこととなった子どもに対する支援に関する施策その他の必要な施策を講ずるものとする。 |
(Assistance to the Victims living in areas outside of the Target Support Areas) Article 9 In order to support the Victims who have moved from the Target Support Areas and reside in areas other than the Target Support Areas, the State shall take measures such as supporting the Victims to move from the Target Support Areas, securing housing at the destination, supporting the learning of the children at the destination, supporting employment at the destination, assisting the Victims to receive the services provided by the local government at the destination without any difficulty, maintaining the relationship with the local government in the Target Support Areas, supporting the children who have ended up living apart from their families, and any other necessary measures. |
| （支援対象地域以外の地域から帰還する被災者への支援） 第十条 国は、前条に規定する被災者で当該移動前に居住していた地域に再び居住するもの及びこれに準ずる被災者を支援するため、当該地域への移動の支援に関する施策、当該地域における住宅の確保に関する施策、当該地域における就業の支援に関する施策、当該地域の地方公共団体による役務の提供を円滑に受けることができるようにするための施策、家族と離れて暮らすこととなった子どもに対する支援に関する施策その他の必要な施策を講ずるものとする。 |
(Assistance to the Victims returning from areas outside the Target Support Areas) Article 10 In order to support the Victims mentioned in the preceding Article who are moving back to the areas where they used to reside or those who are in similar circumstances, the State shall take measures such as supporting the move to the said areas, securing the housing at the said areas, supporting employment at the said areas, assisting the Victim to receive the services by the local governments at the said areas without any difficulty, supporting the children who have ended up living apart from their families, and any other necessary measures |
| （避難指示区域から避難している被災者への支援） 第十一条 国は、政府による避難に係る指示の対象となっている区域から避難している被災者を支援するため、特定原子力事業者（原子力損害の賠償に関する法律（昭和三十六年法律第百四十七号）第三条第一項の規定により東京電力原子力事故による損害の賠償の責めに任ずべき原子力事業者（同法第二条第三項に規定する原子力事業者をいう。）をいう。第十九条において同じ。）による損害賠償の支払の促進等資金の確保に関する施策（当該区域における土地等の取扱いに関するものを含む。）、家族と離れて暮らすこととなった子どもに対する支援に関する施策その他の必要な施策を講ずるものとする。 |
(Assistance to the Victims who have been evacuated from the Areas to which evacuation instuctions have been issued) Article 11 In order to support the Victims who have been evacuated from the areas subject to the evacuation instructions by the Government, the State shall take measures such as securing funds, as in speeding up compensation payments (including those dealing with lands in said areas), by specific nuclear operators (meaning, in accordance with Article 3(1) of the Act on Compensation for Nuclear Damages (Act Number 147 of 1951), the nuclear operators (as defined in Article 2 (3) of the act) who are liable to pay compensation for the damages caused by the TEPCO Nuclear Accident. Same meaning in Article 19) , assisting children who have ended up living apart from their families and any other necessary measures. |
| ２ 国は、前項に規定する被災者で当該避難前に居住していた地域に再び居住するもの及びこれに準ずる被災者を支援するため、前条の施策に準じた施策を講ずるものとする。 | 2. In order to support the Victims who are returning to the areas where they used to reside before the said evacuation as set out in the preceding clause, the State shall take measures to conform to the measures set forth in the preceding Article. |
| （措置についての情報提供） 第十二条 国は、第八条から前条までの施策に関し具体的に講ぜられる措置について、被災者に対し必要な情報を提供するための体制整備に努めるものとする。 |
(Providing information on measures) Article 12 The State shall endeavour to establish systems to provide necessary information to the Victims concerning the concrete measures to be taken in relation to the measures set out in Articles 8 to 11. |
| （放射線による健康への影響に関する調査、医療の提供等） 第十三条 国は、東京電力原子力事故に係る放射線による被ばくの状況を明らかにするため、被ばく放射線量の推計、被ばく放射線量の評価に有効な検査等による被ばく放射線量の評価その他必要な施策を講ずるものとする。 |
(Survey on the health effects of radiation, and the provision of health care and suchlike) Article 13 In order to clarify the situation of radiation exposure caused by the TEPCO Nuclear Accident, the State shall take measures such as estimating the radiation exposure doses and evaluating the exposure doses using tests effective for dose assessment, and any other necessary measures. |
| ２ 国は、被災者の定期的な健康診断の実施その他東京電力原子力事故に係る放射線による健康への影響に関する調査について、必要な施策を講ずるものとする。この場合において、少なくとも、子どもである間に一定の基準以上の放射線量が計測される地域に居住したことがある者（胎児である間にその母が当該地域に居住していた者を含む。）及びこれに準ずる者に係る健康診断については、それらの者の生涯にわたって実施されることとなるよう必要な措置が講ぜられるものとする。 | 2. The State shall take necessary measures in relation to implementing regular medical checkups for the Victims and conducting other surveys on health effects from radiation exposure caused by the TEPCO Nuclear Accident.In this case, at least in relation to those who have resided as children in the areas with radiation levels measured above a certain threshold (including those who were fetuses when their mothers have resided in such areas) and those in similar circumstances, the measures shall ensure the said Victims have lifelong medical checkups. |
| ３ 国は、被災者たる子ども及び妊婦が医療（東京電力原子力事故に係る放射線による被ばくに起因しない負傷又は疾病に係る医療を除いたものをいう。）を受けたときに負担すべき費用についてその負担を減免するために必要な施策その他被災者への医療の提供に係る必要な施策を講ずるものとする。 | 3. In relation to the expenses to be borne by Victims who are children or pregnant women (excluding medical care relating to injuries or illnesses not caused by radiation exposure due to the TEPCO Nuclear Accident) when receiving medical care, the State shall take measures necessary to reduce the financial burden or any other measures relating to the provision of medical care to the Victims. |
| （意見の反映等） 第十四条 国は、第八条から前条までの施策の適正な実施に資するため、当該施策の具体的な内容に被災者の意見を反映し、当該内容を定める過程を被災者にとって透明性の高いものとするために必要な措置を講ずるものとする。 |
(Reflection of opinion) Article 14 In order to contribute to the proper implementation of the measures set out in Articles 8 to 13, the State shall reflect the opinions of the Victims within the specific contents of the said measures and shall take necessary measures to ensure that the procedures of determining the said contents are highly transparent. |
| （調査研究等及び成果の普及） 第十五条 国は、低線量の放射線による人の健康への影響等に関する調査研究及び技術開発（以下「調査研究等」という。）を推進するため、調査研究等を自ら実施し、併せて調査研究等の民間による実施を促進するとともに、その成果の普及に関し必要な施策を講ずるものとする。 |
(Survey and research and dissemination of the results) Article 15 In order to promote the survey and research and the development of technology concerning the impact of low dose radiation on human health (hereinafter referred to as “Research”), the State shall carry out Research itself, promote Research to be carried out by the private sector and take necessary measures to disseminate the results of Research. |
| （医療及び調査研究等に係る人材の養成） 第十六条 国は、放射線を受けた者の医療及び調査研究等に係る人材を幅広く養成するため、必要な施策を講ずるものとする。 |
(Development of personnel involved in medical care and Research) Article 16 The State shall take necessary measures to develop a broad range of personnel to participate in medical care for those who have been exposed to radiation and to conduct Research, |
| （国際的な連携協力） 第十七条 国は、調査研究等の効果的かつ効率的な推進を図るため、低線量の放射線による人の健康への影響等に関する高度の知見を有する外国政府及び国際機関との連携協力その他の必要な施策を講ずるものとする。 |
(International Cooperation) Article 17 In order to promote effective and efficient implementation of Research, the State shall coordinate and cooperate with foreign governments and international organizations which have advanced knowledge of the impact of low dose radiation on human health and shall take any other necessary measures. |
| （国民の理解） 第十八条 国は、放射線及び被災者生活支援等施策に関する国民の理解を深めるため、放射線が人の健康に与える影響、放射線からの効果的な防護方法等に関する学校教育及び社会教育における学習の機会の提供に関する施策その他の必要な施策を講ずるものとする。 |
(Understanding of the people) Article 18 To deepen public understanding of radiation and Victim Living Support Measures, the State shall take measures to provide opportunities for the people to learn, through school and social education, the impact of radiation on human health and the effective methods of protection from radiation. |
| （損害賠償との調整） 第十九条 国は、被災者生活支援等施策の実施に要した費用のうち特定原子力事業者に対して求償すべきものについて、適切に求償するものとする。 |
(Coordination with Damages) Article 19 The State shall seek reimbursement from specific nuclear operators for the costs required to implement Victim Living Support Measures. |
